1. Seller identification

This website, braguscamp.com, is owned by BRAGUSCAMP S.L. 2. Purpose and acceptance

These General Terms and Conditions govern the sale of products through braguscamp.com between Braguscamp and the customer. By placing an order, the customer declares that they are of legal age, have the legal capacity to enter into contracts and have read and accepted these terms, which they may save and print at any time.

Braguscamp may update these terms at any time. The terms in force on the date each order is placed shall apply.

3. Products and information

Braguscamp sells roof tents of its own manufacture, awnings, portable fridges, portable power and accessories for 4x4 vehicles, SUVs and campervans. Photographs, dimensions and weights are for guidance only and may show slight variations in colour, finish or design due to product improvements, without affecting functionality.

It is the customer's responsibility to check before purchase that their vehicle and roof bars are compatible with the product and that the maximum dynamic load stated by the vehicle and roof bar manufacturers is sufficient for the weight of the tent. We offer free advice via WhatsApp before you buy.

4. Prices, taxes and errors

Prices are stated in euros and include the applicable VAT. Shipping costs are not included unless otherwise stated and are shown to the customer before the order is confirmed. For shipments to the Canary Islands, Ceuta, Melilla or outside the European Union, any import taxes and customs formalities are the responsibility of the recipient.

If, due to an obvious typographical or IT error, a product is displayed at a manifestly incorrect price, Braguscamp will inform the customer and give them the option of confirming the order at the correct price or cancelling it with a full refund.

5. Purchase process and confirmation

The customer may purchase as a guest or with a user account. After completing payment, they will receive a confirmation email with a summary of the order. The contract is deemed concluded at that moment. The invoice is available in the customer area and is sent by email.

Braguscamp reserves the right to refuse or cancel orders in the event of lack of stock, incorrect details or signs of fraud, refunding any amount paid where applicable.

6. Availability and pre-orders

If a product is not in stock, it may be purchased as a pre-order where indicated. The estimated waiting time will be up to 40 days, unless a different period is stated on the product page. During this period the customer may cancel their pre-order and will receive a refund of the amount paid. Financed orders cannot be placed as pre-orders.

7. Payment methods

We accept credit or debit cards (Visa, Mastercard), PayPal and deferred payment with seQura, subject to approval by the financial institution. Cash on delivery is not accepted. Payment details are processed on the secure platforms of the payment providers; Braguscamp does not store your card details. Ownership of the products passes to the customer once the price has been paid in full.

8. Shipping and delivery times

Orders are prepared and dispatched Monday to Friday before 12:00, on working days. Estimated delivery times, counted from dispatch of the order, are:

Delivery times are for guidance only and may be affected by logistics incidents beyond Braguscamp's control (strikes, weather conditions, transport network congestion, customs inspections, local holidays, etc.). In such cases we will keep you informed.

The customer must provide a correct address and contact telephone number and ensure that someone is available to receive the order. Roof tents are delivered on a pallet or as a large package at street level or at an entrance accessible to the delivery vehicle. If delivery cannot be made for reasons attributable to the customer (absence, incorrect or inaccessible address), the costs of a second delivery or of storage will be borne by the customer.

You may cancel your order free of charge as long as it has not left our warehouse, by writing to us as soon as possible via WhatsApp or email. If the order has already been dispatched, the cancellation will be processed as a withdrawal: the refund will be reduced by the cost of transport for returning the order to our warehouse, and the refund will be made once the product has been received and inspected.

11. Right of withdrawal (14 days)

If you are a consumer, you have 14 calendar days from receipt of the order to withdraw from the purchase without giving any reason. To exercise this right, inform us clearly by email (info@braguscamp.com) or WhatsApp, stating your order number.

• The product must be returned unused, not fitted to the vehicle, complete (accessories, fixings, manuals) and in its original packaging in good condition, properly protected for transport.
• Return costs are borne by the customer. Due to the size and weight of roof tents, the approximate cost of collection can be checked with us in advance.
• We will refund the amount paid, including the original standard shipping costs, within a maximum of 14 days from notification of the withdrawal. We may withhold the refund until we have received and inspected the product.
• The customer is liable for any diminished value of the product resulting from handling other than what is necessary to establish its nature and functioning (use, fitting, dirt, odours, damage or missing parts or packaging). In that case, the corresponding amount will be deducted from the refund.
• The refund will be made using the same payment method used for the purchase.

The right of withdrawal does not apply to products made to the customer's specifications or clearly personalised, nor to sealed products which are not suitable for return for hygiene reasons and have been unsealed after delivery.

12. Guarantee

All our products come with the 3-year legal guarantee from delivery against lack of conformity, in accordance with Spanish consumer legislation. In the event of a defect, Braguscamp will carry out repair, replacement, a price reduction or termination of the contract as legally applicable. As manufacturers, we have our own spare parts and technical service.

The guarantee does not cover damage caused by:

• Improper or negligent use or use contrary to the instructions, impacts, accidents or overloading.
• Incorrect fitting, unsuitable roof bars or mounts, or exceeding the dynamic load of the vehicle or roof bars.
• Storing the tent closed while damp or wet for a prolonged period (mould, stains or odours), lack of maintenance or cleaning with unsuitable products.
• Normal wear and tear from use (fabrics, zips, rubber seals, mattress), prolonged exposure to extreme conditions, or modifications and repairs carried out by third parties.

To make a guarantee claim, contact us via WhatsApp or email, stating your order number, a description of the problem and photographs or video. Braguscamp may request an inspection of the product to verify the cause of the issue; if the damage is not covered by the guarantee, the customer will be given a quote for the repair and transport.

13. Collection and fitting at our warehouse

Customers who wish to do so may collect their roof tent from our warehouse in Villalbilla (Madrid) by appointment only. In that case, fitting to the vehicle is free of charge; the only cost is an eco-fee for recycling the cardboard and plastic packaging. The customer must arrive with suitable roof bars already installed. Braguscamp may refuse to carry out the fitting if the roof bars or the vehicle do not offer sufficient safety conditions.

14. Customer service

Our customer service operates via WhatsApp (+34 690 08 68 20) and by email (info@braguscamp.com), Monday to Friday. We respond to enquiries, incidents, suggestions and complaints as quickly as possible.

15. Liability and force majeure

Braguscamp shall not be liable for delays or non-performance due to force majeure or causes beyond its reasonable control, nor for damage resulting from use or installation of the product contrary to the instructions. Braguscamp's liability is limited, to the extent permitted by law, to the amount of the order, without prejudice to the rights granted to consumers by law.

16. Intellectual property

All content on braguscamp.com (texts, photographs, videos, designs, logos and trademarks) is the property of Braguscamp or its licensors. Its reproduction or use without express authorisation is prohibited.

17. Data protection

The personal data provided are processed in accordance with our Privacy Policy for the purpose of managing orders, invoicing, shipping and customer service.

18. Language, invalidity, governing law and jurisdiction

The contract is concluded in Spanish. Translations into other languages are for information purposes only; in the event of any discrepancy, the Spanish version shall prevail. If any clause is declared invalid, the remaining terms shall remain in force.

These terms are governed by Spanish law. For any dispute with consumers, the courts and tribunals of the consumer's place of residence shall have jurisdiction. In all other cases, the parties submit to the courts and tribunals of Madrid.
